Liability for the Crime of Driving a Motor Vehicle in the State of Intoxication or under the Influence of Drugs (Article 178a Cc)

Abstract

The following article is an analysis of the model of criminal liability for the crime of driving a motor vehicle in the state of intoxication or under the influence of drugs. The aim of the study is to characterize the statutory features of the crime in the basic type (Article178a § 1 CC) and the aggravated type (Article 178a § 4 CC) and to present the threat of punishment, penal measure and compensatory measures. Particular attention was paid to the effects of alcohol on the efficiency and psychomotor skills of a person driving a motor vehicle. The study presents the scale of the phenomenon in Poland and discusses the efectiveness of criminal repression against perpetrators of these crimes.
