Abstract
The article presents the institutional framework for evidence from expert opinions in judicial,
administrative and administrative court proceedings. The author presents the systemic position
of the expert, the legal nature of the opinion prepared by him and the resulting consequences
for its classification as an official document within the meaning of the provisions of the Act on
access to public information. The article indicates the views of the jurisprudence and doctrine
on this issue. In the author’s opinion, problems with the classification of an opinion as public
information result from the lack of comprehensive regulation of the institution of an expert in
the Polish legal system. Only the regulation of this issue will eliminate the problems associated
with it.
